Terms of Service

These Terms govern your use of TalkOtter at talkotter.com (the "Service"). By using the Service you agree to them. If you don't agree, please don't use the Service.

1. The Service

TalkOtter is a free, browser-based chat service offering real-time messaging, voice notes, photo sharing, random matching, Moments and a Photo Wall. We may add, change or discontinue features at any time, and we may set limits (such as file sizes or rate limits) to keep the Service healthy.

2. Accounts

You may use the Service as a guest or with an email-bound account. You are responsible for keeping your password confidential and for activity under your account. Guest accounts that remain inactive for an extended period may be cleaned up automatically. You may stop using the Service at any time; contact us to request account deletion.

3. Acceptable Use

You agree not to use TalkOtter to:

harass, threaten, defame or bully anyone;
share content that is illegal, sexually explicit involving minors, or that infringes others' rights;
send spam, phishing links, malware or unsolicited advertising;
impersonate another person or misrepresent your identity in a deceptive way;
scrape, reverse engineer, overload or otherwise disrupt the Service or its infrastructure;
use the Service if you are under 13 (or under 16 where required by law).

We may suspend or remove accounts and content that violate these rules, without prior notice where reasonably necessary.

4. Your Content

You keep ownership of content you create on TalkOtter (messages, photos, posts). You grant us a limited, worldwide, non-exclusive license to host, store, transmit and display that content solely to operate the Service. When your content is deleted (by you or by cleanup), it is removed from public view; residual copies may persist in backups for a limited period.

5. Privacy

Our handling of personal data is described in the Privacy Policy, which is part of these Terms.

6. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted availability, data loss prevention, or the accuracy of any content shared by users. Interactions with other users are at your own risk — be careful about what personal information you share with strangers.

7. Limitation of Liability

To the maximum extent permitted by law, TalkOtter and its operators shall not be liable for any indirect, incidental, special or consequential damages, or for data loss, arising from your use of the Service.

8. Changes

We may update these Terms. If a change is material, we will surface it in the Service. Continuing to use TalkOtter after changes take effect means you accept the updated Terms.
